In this Data Protection Notice we want to provide you with all necessary information on the handling of your personal data when using this website. We are using the definitions in the meanings of the GDPR. Personal data in the context of this Data Protection Notice means any information relating to an identified or identifiable natural person (data subject). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier. Such a reference can e.g. be a name, an identification number, location data, an online identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Please note that when we speak about “we”, “us”, “our” or “RAUM” in the context of this Data Protection Notice, then this refers to the person responsible for the content and the operation of the whole website as disclosed in the Imprint.  

I. GENERAL USE OF THIS WEBSITE

1. VISITING THIS WEBSITE

By visiting this website, the following information of the system that you have accessed the website with are processed:  

  • at the moment we do not have any analytic tool in place to process information regarding your visit on our website. We see a number of clicks and a demographic distribution without any relations to time, browser details or the like.

This data does not give us the possibility to map individual users, since we cannot see the IP address in this context.

There are currently no cookies installed. 

2. SERVICE RELATED DATA

If you wish to book RAUM for one of our service offers, we require contractual information (e.g., subject matter of the contract, term, customer category) from you as our customers, prospective customers and business partners for the purpose of providing contractual services, service and customer care, marketing & advertising.

3. PAYMENTS

We currently accept payments for our services per PayPal and Bank Transfer. The personal details disclosed to us while using this payment process are name and bank account details (bank, IBAN). The transmitted information will be deleted after completion of the order or termination of the business relationship. Statutory retention periods remain unaffected. The legitimate interest on our side lies in the fulfillment of contractual obligations (Article 6 para c GDPR) and response to the current legal requirements (Article 6 para e GDPR).

4. CONTRACTS

The type of information processed, scope and purpose and the necessity depends on the underlying contractual relationship. In accordance thereto, we process data of our contractual partners and prospective parties as well as other clients, customers, clients or contractual partners (all contractual partners) (Article 6 para 1 lit. b GDPR), in order to provide our contractual or pre-contractual services. This usually comprises the master data of our contractual partners (e.g., names, addresses), contact data (e.g., e-mail addresses, phone numbers), contract data (e.g., services used, contract contents) and payment data (e.g., bank details). 

In general, we do not process special or sensible categories of personal data (e.g., confession, health), unless this would be required for commissioned or contractual processing. 

Any disclosure of information to external parties or companies is made only if it is necessary due to a contract or legal requirements. When processing the data provided to us in connection with our services, we act in accordance with legal requirements as well as potential instructions from clients.

The deletion of data takes place when the respective data is no longer required – this happens with the fulfillment of our contractual or legal duties of care or with any warranty and comparable obligations. 

5. POST AND CONTACT FUNCTION ON THIS WEBSITE

If you want to share your thoughts with RAUM you can do this by using the post & comment function. The use of this function requires your name and an email-address. All incoming comments are checked beforehand to avoid any and all mis- and abuse. After the approval of your comment may be visible to the public in connection with your comment. Some incoming comments may be checked through an automated spam detection service. We do not share your data described under this Section with any third parties and solely use it to potentially engage into a conversation with you.  

If you reach out to us via email then we have access to all data that you are disclosing in this email.  

If you leave a comment under one of RAUMs articles, the comment and its metadata are retained indefinitely. This helps us to recognize and approve any follow-up comments automatically instead of holding them in a moderation queue. All data provided from you by commenting below individual articles are made available for an undefined term since we want to give other readers the opportunity to read about your thoughts. If at some point you wish to have your comment removed then you can of course contact us to delete it. Apart from that you can use a pseudonymised name when entering it into the commentary box. This does work also for your email-address but then you need to bear in mind that in this event RAUM has no further chance of reaching out to you.  

By engaging with us to interact with RAUM we understand that you are giving us your consent when providing data. Therefore, our legal basis for the processing and storage of data in the course of the commentary function is your consent for this specific purpose (Art. 6 para 1 lit. a GDPR). Additionally, RAUM may store the data described under this Section for documentation purposes. The legal basis for this is our legitimate interest (Article 6 para 1 lit.  f  GDPR). RAUM’s legitimate interest in storing this kind of data is (i) to understand our readers, students and clients better, (ii) to ensure that this website works smoothly and (iii) most importantly to avoid abusive behaviors on this website. 

We do not tolerate any written and / or verbal attacks that do not comply with our principles, i.e., we WILL report any insults, hate comments, offenses and / or other negative experiences, etc. that are aimed against us and the LGBTQIA+ community in the context of using the comment tool (and obviously also if received via email). To be able to make a report, we will share all data available to us with respective organizations. RAUM’s legal basis for sharing personal data for the purpose of reporting violence against us and|or the LGBTQIA+ community is (i) the necessity to protect the vital interests of a natural person (Article 6 para 1 lit. e  GDPR) in the event that the offense is targeting an individual person or several individuals, as well as (ii) our legitimate interest (Article 6 para 1 lit. f GDPR) in protecting the rights of the LGBTQIA+ community.

Our website uses Google Fonts, a service by Google LLC, to ensure consistent and appealing font display across different devices. This is necessary for proper font display and is based on our legitimate interest (Article 6 para 1 lit f GDPR).

The content disclosed via those hyperlinks is not in any way controlled by us. I. General Terms & Conditions

§ 1 Basic provisions

(1) The following terms and conditions apply to all contracts that you conclude with us as a provider RAUM via the website raumpourtoi.com, via email or any other valid forms concluding contracts. Unless otherwise agreed, we do not accept the inclusion of opposing terms and conditions.

(2) A consumer within the meaning of the following provisions is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.

§ 2 Entering into contracts

(1) The subject of the contract is the offering of holistic services in the form of courses, workshops, retreats and trainings

By posting the respective course offer on our website, we submit a non-binding offer to conclude a contract under the terms and conditions stated in the respective description. You can submit a binding offer (order) via our Online Form or by reaching out to us via our available channels.

(3) It is important that you provide us with a correct email address when booking online and check your spam folder in case of doubt. If you have any problems, please do not hesitate to contact us.

§ 3 Provision of services

The performance of the services in the form described in the respective offers takes place on the agreed dates and times.

§ 4 Cancellations

If you wish to cancel your session, you can do this by e-mailing us via raumpourtoi@gmail.com until 24h prior to the session. Subsequent cancellations cannot be considered. In the event of a good cause for your cancellation, please reach out.

If you have booked an individual ticket via the instant payment system, you will receive a refund of what you have paid. If you are canceling a session booked from a quantity ticket, you will receive the credit from the course visit back.

(2) In the event of non-attendance, partial attendance or cancellation later than 24h prior to the start of the booked session, no refund of payments is possible.

§ 5 Choice of Law, Legal Venue, CISG

(1) French law applies. In the case of consumers, this choice of law shall apply only to the extent that the protection afforded by mandatory provisions of the law of the country of the consumer’s habitual residence is not thereby withdrawn.

(2) Insofar as you are not a consumer but a merchant, a legal entity under public law or a special fund under public law, the place of performance for all services arising from the business relations with us as well as the place of jurisdiction shall be our registered seat, The same shall apply if you do not have a general place of jurisdiction in France or the EU or if your place of residence or habitual abode is unknown at the time the action is brought. The right to also call upon the court at another legal place of jurisdiction remains unaffected by this. 

(3) The provisions of the UN Convention on Contracts for the International Sale of Goods shall expressly not apply.

The European Commission provides a platform for the out-of-court settlement of disputes online (ODR platform), which can be accessed at https://ec.europa.eu/odr. We are not willing to participate in dispute resolution proceedings before consumer arbitration boards.

For the technical steps that lead to the conclusion of a contract, the the conclusion of the contract itself and any changes thereto post conclusion follow the provisions under Sec. 2 of the Terms & Conditions.

3. Contract Language, Contract Information

(1) Contract language is English or French. However, RAUM usually operates in the English Language. If you receive some information in English and require them in French, German or Spanish, feel free to reach out.

(2) If you wish to receive an offer outside of the online booking system you can contact us. In this case you will receive all contract data as part of a binding offer sent in text form, e.g. by email, which you can print out or save electronically.

4. Essential characteristics of the services

5. Prices and Payment

(1) The prices listed in the respective offers represent total prices. They include all price components including all applicable taxes.

(2) Unless otherwise specified in the individual payment methods, the payment claims arising from the concluded contract are due for payment immediately.

(3) Unless otherwise agreed, payment for course bookings must be made no later than the course date on site before the start of the course, otherwise there is no right to participate.
